Abstract
The position of the village is a forerunner to the formation of the state; however village is not region in the constitutional construction of the unitary state of the republic of Indonesia (NKRI). It is because the village did not receive the devolution of authority from the state, although the village is recognized as part of NKRI. Indeed, this is contrary to the implementation of the regional autonomy, which is puts the village as sub-systems of the local government of district/city, so it made implication for the less maximum of the implementation of the village autonomy based on the original rights of the village which recognized and respected by the state, because village is also implementing the autonomy given by the district/city.
