The concept of waste in Moroccan law: from the absence to the legal recognition

At first sight, the concept of waste seems easy to perceive by any individual. Notwithstanding, it is delicate enough, and even probably impossible, to develop a precise legal definition of what is a waste (BONTOXE&LEONE, 1997). In addition, the term waste returns to a depreciation (DE CONINCK, 1997) of the value of the object. The concept of waste is relative as well in relation to space as to time (DE CONINCK, 1997). The relativity of the concept of waste can also be seen in relation to the technological evolution and the place of production (BONTOXE&LEONE, 1997). In this article, we are trying, in the first place, to highlight the evolution of the legal apprehension of the concept of waste, to interrogate, in second place, on the criteria for the distinction between the “waste” and the “not waste”.
