SEXUAL EXPLOITATION AND ABUSE OF MINORS: LEGAL FRAMEWORKS AND PROTECTION OF MECHANISMS

Abstract

The sexual exploitation of minors is a serious crime and violation of human rights as well, with the destructive consequences for the victims, their families and their society as a whole. This research document is deepened in the legal framework which is intended to combat the sexual exploitation of children, the study of international and national laws aimed at preventing, pursuing and protecting minors against sexual violence and its functioning. The study begins through analyzing of various legislative frameworks, such as the Protection of Children from Sexual Offences (POCSO) Act in India, including international instruments like United Nations Convention on the Rights of the Child (CRC), the optional Protocol on illegal Sale of Children, Child Prostitution and Child Pornography and National law protocols such as the U.S. Act on Protection of the United States, these legal framework established and still develops a comprehensive system for addressing by defining offences, ensures child protection and by holding perpetrators accountable for their actions. Additionally, the study examines protective mechanisms such as child protection programs, online security initiatives and victim support services, highlighting the joint role of law enforcement, non-governmental organizations and communities in protecting children. By critically assessing these legal and protective structures, the research seeks to identify the gaps in the current systems and propose recommendations for strengthening efforts to prevent sexual exploitation and abuse of minors. The POCSO Act, is a significant development in Indian law for instance as it provides child-friendly approaches in legal proceedings, by recognizing unique susceptibility of children.
